Terms and Conditions – Aussie Fireworks (Melbourne)
These Terms and Conditions apply to all fireworks displays and associated services provided by Aussie Fireworks, Melbourne. By confirming a booking, the client agrees to the following:
1. Products and Services
1.1 Validity
- All prices quoted are fixed and valid for thirty (30) days from the date of quotation.
- Product availability may vary. If a quoted product is unavailable on the event day, it will be replaced with a product of equal value and quality.
- Display content may be adjusted on-site to meet State Regulations and safety standards. No refunds will be issued for substitutions or omissions necessary for safety or legal compliance.
- Under current legislation, the client is hiring Aussie Fireworks for a service, not buying fireworks as a product. All fireworks and pyrotechnic materials remain the property of Aussie Fireworks at all times.
- Safety and Public Issues
- Aussie Fireworks staff will determine the safe public viewing area for the display.
- The client is responsible for:
- Monitoring patron behaviour at the venue.
- Providing crowd control, security and safety fencing before, during and after the display.
- The client must prevent any unauthorised access to Aussie Fireworks’ equipment before, during and after the event.
- The event organiser must obtain landowner permission for the fireworks display site at least 14 days prior to the event. Completion of the booking form is deemed confirmation that landowner consent has been obtained.
- The organiser must notify nearby residents and businesses at least 3 days before the event. Aussie Fireworks can provide this service for an additional fee.
- Any product malfunctions or client concerns should be reported either at the event or within 24 hours to the Display Manager or Aussie Fireworks Head Office.
- Insurance
- Aussie Fireworks maintains $20 million Public Liability Insurance.
- Any specific insurance wording or indemnifications required by the client must be requested at least 14 days prior to the event date.
- Scripted Event Activations with Musical Soundtracks
- The client must complete and submit the Aussie Fireworks Online Booking Form at least 40 days before the event.
- The client must either:
- Provide a pre-approved soundtrack, or
- Approve a soundtrack prepared by Aussie Fireworks at least 30 days prior to the event.
- If the above deadlines are not met, Aussie Fireworks will finalise the soundtrack at its sole discretion, and no further client input will be accepted.
- The client is responsible for obtaining any required APRA and/or AMCOS music licences for their event.
5. Payment Schedule and Terms
5.1 Deposit
- Submission of the Online Booking Form will generate an invoice for a 50% non-refundable deposit, which secures the event date.
- The event will not be scheduled until this deposit has been received in full.
5.2 Remaining Balance
- The remaining 50% balance is due no later than 30 days before the event.
- Events booked within 4 weeks (28 days) of the event date require full payment upon booking.
- If payment is not received by the due date, Aussie Fireworks may cancel the display unless alternative arrangements have been agreed in writing.
Invoices unpaid more than 30 days after the due date may incur a 5% late fee per month, compounded monthly, on the outstanding balance until paid in full.
6. Postponement and Cancellations
6.1 Postponement
- If the event cannot proceed due to unsafe weather conditions or other safety concerns, both parties may agree to postpone or cancel in line with the cancellation fee schedule below.
- Postponement requests must be made in writing, and the new event date must be mutually agreed.
6.2 Cancellations by the Client
- More than 14 days (for projects booked on account/post-event invoice):
- A $250.00 cancellation fee applies, plus an invoice for any works already completed.
- More than 14 days (standard bookings):
- Aussie Fireworks retains or invoices the 50% non-refundable deposit.
- Less than 14 days:
- Aussie Fireworks retains or invoices the 50% deposit and may invoice for any additional costs incurred.
- Less than 7 days:
- 75% of the total event cost will be payable, plus any additional costs incurred.
- Less than 48 hours:
- 100% of the total event cost will be payable, plus any additional dismantling or labour costs.
- If any third-party services (e.g. barge hire, security, staging) have been booked, the client must pay all subcontractor costs in full within 7 days of cancellation.
- Any event credit issued due to postponement must be used within 365 days of the original event date.
6.3 Cancellations by Aussie Fireworks
Aussie Fireworks reserves the right to cancel a display before or during the event due to:
- Public safety concerns (e.g. security breaches or dangerous crowd behaviour).
- Product malfunctions that may compromise safety.
- Unsafe weather conditions (e.g. high winds, lightning, extreme fire danger).
6.4 Standard Billing Terms
Unless otherwise agreed in writing, Aussie Fireworks’ standard payment terms are:
For Events More than 30 Days Away:
- Deposit Invoice: 50% of the total project value, due immediately upon booking.
- Balance Invoice: 50% of the total project value, due 30 days prior to the event.
For Events Booked Within 30 Days of the Event:
- A Full Balance Invoice for 100% of the project value.
- The invoice due date is immediate, and payment must be received prior to event delivery.
7. Use of Event Imagery & Marketing
- Aussie Fireworks may use photographs, videos or other recordings of the event for promotional and marketing purposes, unless otherwise agreed in writing with the client.
8. Exclusions & Disclaimer
Aussie Fireworks will not be liable for:
- Any misuse of hired equipment by the client or third parties.
- Cleaning fees before or after the fireworks display.
- Damage arising from unforeseen human intervention or natural disasters.
- Costs associated with fire alarms activated due to the display.
- Any injuries to people or animals caused by noise, vibrations or visual effects from the display.
- Costs associated with events running overtime, including $100.00 + GST per hour per technician for delayed site access or egress.
9. Clean-up & Safety Services
- After the display, Aussie Fireworks will sweep the firing site and remove any unfired pyrotechnic material.
- Some non-hazardous debris (such as small paper or cardboard fragments) may remain on-site. Aussie Fireworks is not responsible for any additional clean-up costs beyond standard post-display procedures.
10. Example Videos & Illustrative Images
All example videos, photos, and images are for illustration only. Actual displays may vary depending on product availability, venue restrictions, and safety considerations.
11. Client Portal & Compliance Onboarding Fees
- If the client requires Aussie Fireworks to onboard to any third-party portal or platform (e.g. payment portals, risk management systems, compliance platforms), any associated platform fees, administrative costs or additional labour will be invoiced to the client in full.
- Aussie Fireworks reserves the right to decline onboarding where the platform requirements are deemed unreasonably complex, time-consuming or cost-prohibitive.
12. Confidentiality & Non-Disclosure Agreement
- By receiving a quote from Aussie Fireworks, whether or not the event proceeds, the client agrees to comply with Aussie Fireworks’ Non-Disclosure Agreement (NDA), available via our office or website upon request.
- This includes maintaining the confidentiality of all pricing, technical details, show designs and proprietary information contained in quotes, proposals and associated documents.
- Any unauthorised sharing, reproduction or distribution of Aussie Fireworks’ confidential information may result in legal action.
13. Client Responsibilities
The client is responsible for:
- Obtaining any necessary APRA and/or AMCOS music licences for their event.
- Monitoring patron behaviour at the venue.
- Providing crowd control, security and safety fencing before, during and after the display.
- Preventing unauthorised access to Aussie Fireworks’ equipment at all times.
- Ensuring permission for the use of the activation site, unless otherwise agreed that Aussie Fireworks will obtain it directly.
- Ensuring they understand and comply with state regulations applicable to organising a fireworks display.
